London 2 Brighton Challenge

Terms and Conditions

London 2 Brighton Challenge | London to Brighton, Walk, Trek, Run 2012These Conditions of Entry serve as a contract between “the Organiser”; Action Challenge UK Ltd, company number 3825838, trading premises Aberdeen Studios 3a, 22 Highbury grove, London N5 2EA and “you” the Participant (as named on the registration form), and The Hunger Project, relating to the London 2 Brighton Challenge 2012 – the ‘Event’.

1. Entering the Event

(a) The Event involves sustained physical exertion and walking at night. Prior to registering to the event you must be satisfied that you are fit and able to take part in the challenge and that there are no medical or other reasons which would reasonably preclude your participation. If in doubt you must consult your Doctor or other medical professional before registering.

(b) You must be 17 years old or over on the date of the Event to participate.

(c) You must register via the online booking form and pay a non-refundable Registration Fee of £75 per person; you will receive an email confirming your registration and payment.

(d) By registering to the Event you accept the terms of the Fundraising Target and agree to donate or fundraise through sponsorship a minimum of £375 for The  Hunger Project at the time of registration, of which a minimum of £100 must be received by The Hunger Project by 31 March 2012 and all sponsorship monies must have been submitted no later than 10 June 2012.

(e) If you or a member of your team fails to submit the £100 minimum fundraising six weeks prior to the challenge then that individual will be precluded from the Event.

(f) If you or member of your team fails to take up their place on the Challenge for any reason then that place on the Event can be transferred to another person for a name change Fee payable to Action challenge of £25 until 31 March 2012, and £75 thereafter provided that Action Challenge are contacted first and provided that all the fundraising commitments to The Hunger Project are met.

(g) If you or a member of your team fails to take up their place on the Event for any reason the remaining Team members will be liable to the Organiser for any short fall in Registration Fees associated with the smaller Team membership if applicable.

(h) The minimum Team size to take part in the Event is three people, and if a Team falls below this number for any reason they will be managed on, and participate within, the Challenge as though they were Registered as Individual participants.

(g) You agree to supply the Organiser with any information as may be requested from time to time in a prompt and timely manner.

(h) You agree to abide by the Event Rules as issued and where updated and notified to you.

(i) You have read and understood the Data Protection question on the registration form.

(j) You undertake to abide by any fundraising guidelines as may be issued by The Hunger Project in respect of your fundraising activities.

(k) You will act responsibly and honestly at all times when representing the Event and will not bring through your actions the Event, us, or The Hunger Project into disrepute.

(l) You participate within the Event entirely at your own risk.

2. Event information

Upon registering to the Event you will be sent a fundraising Information Pack by The Hunger Project, and all other information relating to the Event will be detailed within the Participant Area of the Event website (www.london2brightonchallenge.com); you will be provided with access codes to the Participant Area, and it is your responsibility to read and act on the information supplied.

3. Cost and fundraising

(a) The cost of you taking part in the Event is £150 of which £75 is a non-refundable Registration Fee, and a further £75 is paid by The Hunger Project to the Organiser to confirm your place.

(b) You are making a commitment to fundraise or donate to The Hunger Project a minimum sponsorship target of £375 – where you are unable to meet this target prior to the Event and there is no realistic prospect of your making this pledge by 10 June 2012 you are required to notify the Organiser and The Hunger Project; the Organiser reserves the right to preclude you from the Event without refunding your Registration Fee.

(c) All fundraising monies should be paid as specified by The Hunger Project in the Information Pack that they send to you.

(d) Should you not be able to take up your place on the Event or chose not to for whatever reason, the Registration Fee is non-refundable and any Fundraising monies collected must be returned to the donors or retained by The Hunger Project as agreed between you and The Hunger Project after all donors have been informed. The arrangements for any refunds to sponsorship donors are strictly between The Hunger Project and you in this instance.

4. Itinerary changes

There may be minor changes to your itinerary. Should there be a material change prior to departure which is not a result of force majeure (a departure timing change of more than three hours for example) then the Organiser will inform you as soon as is practicable and in this case you may either agree to proceed with the new itinerary or cancel your participation in the Event, in which case you will receive a full refund of any Registration Fee paid. The arrangements for any refunds to fundraising donors are strictly between The Hunger Project and you in this instance.

5. Changes made by you

Any change must be notified by you to the Organiser by email, by the person named on the registration form completed at the time of booking. We will always try to accommodate reasonable changes requested free of charge; however some changes that you request may incur an administration fee which you will be advised at the time of request before electing to proceed with the change. Name changes incur a fixed administration fee of £25. Changes requested after 31 March 2012 will be liable to a £75 fee.

6. Cancellation by you

You may cancel your participation on the Event at any time by providing emailed notice to us. Your Registration Fee remains non-refundable; however the Organiser may invite you to transfer this Fee onto another challenge operated by the Organiser at a time in the future but are under no obligation to offer such. In the event of any cancellation you undertake to inform The Hunger Project and the arrangements for any refunds to sponsorship donors are strictly between The Hunger Project and you in this instance. We do not make any payments compensating for losses or costs you incur in the case of a cancellation.

7. Cancellation by the Organiser

(a) The Organiser reserves the right to cancel the Event whether for operational reasons, Force Majeure, or other reasons, in which case a full refund of the Registration Fee paid by you will be made within four weeks of issuing the cancellation notice being issued.

(b) The Organiser will not make any payments compensating for losses or costs you incur in the case of a cancellation and we exclude and limit all such liability to the full extent permitted under law.

(c) The Organiser does not accept liability for any delays in your travel arrangements, or reasonable changes to the Event itinerary in circumstances of Force Majeure. Force Majeure means any unusual or unforeseen circumstances beyond our reasonable control including but not limited to an act of God, war, accident, road closures, failure of power supply, abnormal weather, fire, explosion, or labour disturbance.

8. The Organisers’ obligations to you

(a) The Organiser will provide medical support on the Event, and the prime role of the medical support teams will always be to deal with genuine medical emergencies as their priority when and where they are required to do so. You must bring your own small personal medical kit and follow the equipment and clothing advice as issued.

(b) The Organiser will provide food and water on the Event, and it is your responsibility to remain fed and hydrated, and should follow the nutritional advice as issued.

(c) Whilst the Event route will be signed and a route card will be provided to you, it is your responsibility not to get lost and you must carry a fully charged mobile phone (two if in a team) and you or at least one member of your team must be capable to navigate using a compass and map.

(f) The Organiser will manage the exit of participants who drop-out from the Event, having started it, in a way that they deem is correct, safe and relevant for the overall management of the Event. You are advised to have a friend or relative that you can contact in case you choose to exit from the event prior to the finish in Brighton.

(g) The Organiser accepts liability for negligent acts and/or omissions by its our employees, agents, suppliers or sub contractors whilst acting within the scope of, or in the course of their employment in the provision of any part of the Event that we are contractually obliged to provide. The Organiser will therefore pay such damages as may be awarded under English law.

(h) The Organiser excludes and limits all other liability to the extent permitted under law and damages are not payable where any failure to perform the contract is due neither to any fault on the part of the Organiser or a supplier of any part of your arrangements associated with the Event, or is attributable to you or unforeseen or unavoidable actions of a third party unconnected with the provision of services associated with the Event, or a force majeure circumstances beyond the Organiser’s control.

9. Insurance

You agree to read and abide by the Event Insurance Advice where issued and accept that Personal liability and Personal Accident Insurance is NOT included in the cost of the Event.

10. Law and jurisdiction

These terms and conditions shall be governed by and construed in all respects in accordance with the laws of England and Wales. Any dispute which may arise between the parties concerning these terms and conditions shall be exclusively determined by the English Courts.
